Terms of Service¶

These Terms of Service ("Terms") govern your access to and use of Budhil (the "Service"), operated by [Budhil Ltd] ("Budhil", "we", "us"). By creating an account or using the Service you agree to these Terms. If you don't agree, don't use the Service.
These Terms are between Budhil and the merchant who operates a store. They do not govern the relationship between a merchant and the merchant's own customers — each merchant sets its own store policies.
1. The Service¶
Budhil is a hosted platform that lets you build and run an online store. We provide the storefront, admin tools, hosting, and included features (such as discounts, abandoned-cart recovery, reviews, and email). Features may change over time.
2. Eligibility & accounts¶
You must be at least 18 and able to form a binding contract. You're responsible for your account, for keeping your credentials and two-factor authentication secure, and for all activity under your account. Tell us promptly at [support@budhil.com] if you suspect unauthorized use.
3. Plans, fees & billing¶
- Paid plans are billed in advance on a recurring basis (monthly or annually) as shown at sign-up.
- Budhil charges a 0% platform transaction fee — we take no percentage of your sales.
- Payment processing is provided by Stripe, not by Budhil. You connect your own Stripe account; Stripe settles your sales directly to you and charges its own processing fees under Stripe's terms. Budhil is not a payment processor, bank, or merchant of record for your sales.
- Subscription fees are non-refundable except where required by law or expressly stated. You can cancel at any time; cancellation takes effect at the end of the current billing period.
- We may change plan pricing with reasonable notice; changes apply to the next billing period.
4. Your responsibilities as a merchant¶
You are solely responsible for: - Your store's products, content, pricing, and the legality of what you sell. - Fulfilling orders, customer service, shipping, and your own refund/return policy. - Collecting and remitting any taxes you're required to (Budhil does not file or remit taxes for you). - Complying with all laws applicable to your business, and with the Acceptable Use Policy. - Your relationship with your own customers, and your own store privacy/returns policies.
5. Acceptable use¶
Your use of the Service must comply with the Acceptable Use Policy, which is part of these Terms. We may suspend or terminate accounts that violate it.
6. Your content & data¶
You retain ownership of your content and data. You grant us a limited licence to host, process, and display it solely to provide the Service. You can export your store data at any time — see the Privacy Policy for how we handle data and your rights.
7. Intellectual property¶
The Service, including its software, design, and trademarks, is owned by Budhil and protected by law. We grant you a non-exclusive, non-transferable right to use the Service per these Terms. You may not copy, resell, reverse-engineer, or create derivative works of the Service except as permitted by law.
8. Availability¶
We work to keep the Service available but don't guarantee uninterrupted or error-free operation. We may perform maintenance and may modify or discontinue features with reasonable notice where practical.
9. Suspension & termination¶
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, fail to pay, or use the Service unlawfully. On termination we'll make your data available for export for a reasonable period, after which it may be deleted.
10. Disclaimers¶
The Service is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We don't warrant that the Service will meet your requirements or be uninterrupted, secure, or error-free.
11. Limitation of liability¶
To the fullest extent permitted by law, Budhil will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the Service is limited to the amount you paid us in the 12 months before the claim. Nothing limits liability that cannot be limited by law.
12. Indemnity¶
You agree to indemnify and hold Budhil harmless from claims arising out of your store, your products, your content, your breach of these Terms, or your violation of law or third-party rights.
13. Changes to these Terms¶
We may update these Terms. If we make material changes we'll give reasonable notice (e.g. by email or in-app). Continued use after changes take effect means you accept them.
14. Governing law¶
These Terms are governed by the laws of [jurisdiction], and disputes are subject to the courts of [jurisdiction], except where applicable law gives you other rights.
